The process in Germany

Four steps – and your space is yours again.

A stranger's car in your courtyard or underground garage? With FalschParker you record the violation in under 60 seconds and trigger a contractual penalty – digital and free for you.

From the sign to the contractual penalty.

The process

Four steps under German law – you report the violation, we take care of the keeper, the claim and the payment.

  1. Sign at the entrance, plate into the app.

A clearly visible sign at the entrance makes your parking terms part of the contract under Sections 305 et seq. BGB. Use its QR code or the app itself to enter the number plate.

FalschParker: input form for the number plate of a vehicle parked without permission
  2. Prove it with a photo.

Capture the vehicle and its number plate clearly in the frame. The photo relies on legitimate interest (Art. 6(1)(f) GDPR) and serves as evidence.

FalschParker: camera view while photographing the wrongly parked car
  3. Pin the location, identify the keeper.

The app takes the GPS position and you confirm it with one tap. We then request the keeper details from the Federal Motor Transport Authority (Section 39 StVG).

FalschParker: map with the location of the parking violation marked
  4. Contractual penalty – we do the rest.

You assign the claim to ParkGuard (Section 398 BGB). We pursue the contractual penalty, answer questions by phone and handle debt collection where needed.

Legal basis

FalschParker offers comprehensive tools for private individuals, property managers, shopping centres and businesses of every size.

  • Recognised by the highest courts.

The German Federal Court of Justice (BGH) has confirmed in several rulings that claims for unauthorised parking on private property may be enforced.

  • No prior injunction required.

You can assert claims even without a prior court injunction. A clearly visible no-parking sign already establishes a valid usage relationship.

  • Possession protection under the BGB.

Parking on private property without authorisation constitutes a disturbance of possession under Sections 858, 862 BGB. As an owner or tenant, you have the right to protect your property and claim the costs incurred.

  • Data-protection compliant (GDPR).

All data is processed in accordance with the GDPR and BDSG. Proof photos and vehicle data are used solely to enforce legitimate claims.

FAQ

You ask, we answer.

View all FAQs
  • Is FalschParker really free?

Yes, it is completely free for parking space owners and tenants. You incur no costs – the fees are collected directly from the wrongful parker.

  • What happens if the wrongful parker doesn't pay?

If the compensation isn't paid on time, we initiate the collection process. We handle all further steps – you don't have to do anything else.

  • Do I need a court injunction to issue a compensation notice?

No, a court injunction is not required. You can claim compensation for unauthorised parking on your private space even without one. An existing injunction does, however, enable additional legal steps such as a criminal complaint.

  • How quickly does the tow truck arrive?

Our GPS-based network of towing providers automatically identifies the nearest available driver. You can track the tow truck’s arrival in real time on the map.

  • How high is the contractual penalty?

It depends on the terms of use of the car park in question: the amount is stated on the sign at the entrance and must be reasonable (§ 307 BGB). See our blog post “How high can a private parking penalty be in Germany?” for details.

  • What data is collected and how is it protected?

We collect licence plates, proof photos and GPS location. All data is processed in accordance with the GDPR and used solely to enforce your legitimate claims.
